These Terms of Service (“Terms”) govern your access to and use of orthofiapp.com (the “Site”) and the pre-qualification form, calculator, and editorial content we publish (collectively, the “Services”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site. Read our Privacy Policy and Advertising Disclosure alongside this document.

1. Acceptance of terms

By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Advertising Disclosure. If you access the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Who we are

OrthoFi App is an independent consumer-education website. We publish research, reviews, comparisons, and tools covering orthodontic patient financing products in the United States. We are not OrthoFi, Inc., OrthoBanc, AcceptCare, or any lender featured on this site. We are not a bank, a lender, a loan servicer, a credit repair organization, a credit counselor, a financial advisor, a dental or orthodontic practice, or a healthcare provider. Trademarks referenced on the Site belong to their respective owners and are used solely for identification and comparison under nominative fair use.

3. No financial, legal, or medical advice

Rates, fees, terms, product features, state availability, and other product details change frequently and may differ from what is published on this Site. You are solely responsible for verifying information with the lender, orthodontic practice, or product provider before entering into any agreement.

Specifically regarding orthodontic treatment: the choice of orthodontist, treatment type, payment plan, and whether to accept financing is a personal decision that depends on your clinical needs, financial situation, and risk tolerance. We do not recommend any particular orthodontist, treatment, lender, or financing structure for your situation.

4. Affiliate relationships and compensation

In accordance with the Federal Trade Commission's Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 CFR Part 255), we disclose that:

• We participate in affiliate programs, including as a publisher on the APIdiamond network and, where applicable, with other consumer finance partners.
• When you submit the pre-qualification form or click through to an advertiser via certain links, we may earn a commission if you are matched with a lender and complete certain actions (such as receiving a loan offer or funding).
• Our compensation does not depend on which specific lender funds your loan, nor on the loan amount or interest rate you receive.
• Editorial content — reviews, comparisons, ratings, and ratings methodology — is produced independently of our affiliate relationships. Our editorial team does not have access to real-time commission data and does not change rankings or recommendations based on commission potential.
• Some links on the Site are marked with rel="sponsored" or rel="nofollow" consistent with Google's link attribute guidelines; these are affiliate links.

5. Eligibility

To use the pre-qualification form on the Apply page, you must be:

• At least 18 years of age (19 in Alabama and Nebraska, 21 in Mississippi where applicable)
• A legal resident of the United States with a valid Social Security Number or Individual Taxpayer Identification Number
• Not a resident of a state where the form is restricted (currently New York, Vermont, West Virginia, and Arkansas)
• Submitting your own information, not that of a third party, unless you have express written authority to do so

Editorial content on the Site is freely available to all visitors regardless of age or location, subject to applicable local laws.

6. Pre-qualification form

The pre-qualification form is a tool provided by APIdiamond that transmits your information to lenders in its network to generate potential loan offers. Submitting the form:

• Does not guarantee that any lender will approve you or extend an offer
• Does not constitute a loan application in itself — a lender who presents you with an offer will require a separate, complete application for final approval
• Triggers a soft credit inquiry by APIdiamond that does not affect your credit score; a final application by a lender you accept will typically trigger a hard inquiry
• Involves the transfer of your personal and financial information to APIdiamond and participating lenders under their own privacy terms

Loan offers presented through the form are made by third-party lenders, not by OrthoFi App. All loan terms, including interest rate, fees, repayment period, and funding timeline, are determined by the lender and are subject to its underwriting criteria, your credit profile, and applicable state law.

7. Prohibited conduct

You agree not to:

• Use the Site in violation of any applicable federal, state, or local law or regulation
• Submit false, inaccurate, or misleading information through the pre-qualification form or any other form
• Impersonate another person or submit information on behalf of someone else without written authorization
• Scrape, crawl, or systematically retrieve content from the Site other than through standard search engine indexing or the methods allowed in our robots.txt file
• Reverse engineer, decompile, or attempt to extract the source code of any part of the Site beyond what is served to your browser
• Interfere with or disrupt the Site, servers, or networks, including through denial-of-service attacks, injecting malware, or circumventing security measures
• Use the Site to transmit unsolicited commercial communications, spam, or chain letters
• Attempt to access portions of the Site that are not intended for public use (such as administrative paths)
• Use the Site in any manner that could damage, disable, overburden, or impair it

We reserve the right to block access, terminate your use of the Site, and refer suspected illegal activity to law enforcement.

8. Intellectual property

All content published on the Site — including articles, reviews, comparisons, methodology descriptions, payment calculators, charts, diagrams, icons, favicons, logos, custom imagery, custom CSS, and JavaScript — is the property of OrthoFi App or licensed to us, and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may:

• View, read, and print pages for your personal, non-commercial use
• Quote short excerpts (under 15 words) with attribution and a link back to the source page
• Link to our pages from your own site

You may not:

• Republish our content in whole or in substantial part on another website, including by AI summarization or paraphrase that mirrors the structure of our pages
• Use our name, logo, favicon, or trademarks in a manner suggesting endorsement, affiliation, or partnership without our written consent
• Train large language models on our content for commercial redistribution (see our robots.txt for the AI crawler access controls we have in place and our llms.txt for the structured summary we make available for machine readers)

9. Third-party links, products, and services

The Site contains links to third-party websites and references to third-party products (including OrthoFi, OrthoBanc, AcceptCare, CareCredit, Cherry, PatientFi, Sunbit, LendingUSA, Avant, Upstart, and others). These links and references are provided for your convenience and research.

We do not control, and are not responsible for, the content, privacy practices, security, availability, pricing, terms, customer service, or any other aspect of third-party websites, products, or services. Your interactions with any third party, including lenders, orthodontic practices, and payment processors, are solely between you and that third party. Any contract, loan agreement, treatment plan, or dispute is governed by the terms of that third party, not by these Terms.

10. Disclaimers

THE SITE AND ALL CONTENT, INFORMATION, TOOLS, CALCULATORS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

• The Site will be uninterrupted, timely, secure, or error-free
• Information on the Site (including interest rates, fees, state availability, lender names, and product features) is accurate, current, or complete
• Any payment-calculator estimate reflects what you will actually pay
• Pre-qualification results or lender offers accurately predict final loan approval, terms, or funding
• The Site is free of viruses, malware, or other harmful components

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ORTHOFI APP, ITS AFFILIATES, OFFICERS, EDITORIAL TEAM, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER. BECAUSE THE SITE IS FREE TO USE, THIS LIMITATION IS OFTEN $100.00.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless OrthoFi App, its affiliates, officers, editorial team, contractors, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including any content you submit.

13. Governing law and venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any legal action arising out of or relating to these Terms or the Site must be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of those courts.

14. Dispute resolution

If you have a dispute with us, please first contact [email protected] and attempt to resolve it informally. Many disputes can be resolved by email in a short time. If informal resolution fails after 30 days, either party may pursue the dispute in court subject to the governing law and venue provisions above. Nothing in these Terms prevents you from filing a complaint with the Federal Trade Commission, the Consumer Financial Protection Bureau, your state's attorney general, or any applicable regulator.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, for material changes, post a notice on our homepage for at least 30 days. Your continued use of the Site after the effective date of any change constitutes acceptance of the updated Terms. If you do not agree, stop using the Site.

16. Other provisions

16.1 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.2 Waiver

Our failure to enforce any right or provision of these Terms is not a waiver of such right or provision.

16.3 Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms freely in connection with a business transfer.

16.4 Entire agreement

These Terms, together with our Privacy Policy and Advertising Disclosure, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.

16.5 No agency

No agency, partnership, joint venture, employment, or franchise relationship is created by these Terms.
